Application for Shellfish Aquaculture Leases - Kellam & Kellam
Calvert Bay and Smith Creek
The Secretary of Maryland Department of Natural Resources (DNR), pursuant to Natural Resources Article, §4-11A-09(g), Annotated Code of Maryland, is giving notice of applications for two shellfish aquaculture water column leases by Paul Kellam and Judy Kellam in Calvert Bay and Smith Creek, St. Mary's County, Maryland.
The first proposed area, southwest of the mouth of Calvert Creek, contains 3.2 acres, more or less, and is enclosed by a line beginning at corner 1, at or near Lat. 38° 5' 59.0" N., Long. 76° 23' 42.1" W., then running 312° 16' (True), approximately 195 meters to corner 2, at or near Lat. 38° 6' 3.3" N., Long. 76° 23' 48.1" W., then running 41° 33' (True), approximately 66 meters to corner 3, at or near Lat. 38° 6' 4.9" N., Long. 76° 23' 46.3" W., then running 132° 39' (True), approximately 192 meters to corner 4, at or near Lat. 38° 6' 0.8" N., Long. 76° 23' 40.4" W., then running 219° 35' (True), approximately 68 meters to the point of beginning.
The second proposed area, in an unnamed cove on the west side of Smith Creek, contains 4.3 acres more or less and is enclosed by a line beginning at corner 1, at or near Lat. 38° 7' 36.2" N., Long. 76° 24' 59.4" W., then running 331° 44' (True), approximately 75 meters to corner 2, at or near Lat. 38° 7' 38.4" N., Long. 76° 25' 0.9" W., then running 342° 42' (True), approximately 69 meters to corner 3, at or near Lat. 38° 7' 40.5" N., Long. 76° 25' 1.8" W., then running 314° 32' (True), approximately 33 meters to corner 4, at or near Lat. 38° 7' 41.3" N., Long. 76° 25' 2.8" W., then running 279° 46' (True), approximately 38 meters to corner 5, at or near Lat. 38° 7' 41.4" N., Long. 76° 25' 4.3" W., then running 347° 9' (True), approximately 61 meters to corner 6, at or near Lat. 38° 7' 43.4" N., Long. 76° 25' 4.9" W., then running 114° 47' (True), approximately 26 meters to corner 7, at or near Lat. 38° 7' 43.0" N., Long. 76° 25' 3.9" W., then running 89° 10' (True), approximately 46 meters to corner 8, at or near Lat. 38° 7' 43.0" N., Long. 76° 25' 2.0" W., then running 110° 8' (True), approximately 124 meters to corner 9, at or near Lat. 38° 7' 41.7" N., Long. 76° 24' 57.2" W., then running 198° 57' (True), approximately 175 meters to the point of beginning.
The applicant proposes to place cages on the bottom that are no more than 15" high for the purpose of culturing Eastern Oyster (Crassostrea virginica), and to harvest using methods approved by the Department. A map of each of the proposed leases is available below.
The Department will hold a public informational meeting upon written request from a member of the public. In addition, any person who has a specific right, duty, privilege, or interest that is different from that held by the general public and may be adversely affected by one or both of the proposed leases may file a Petition of Protest with the Department. Petitions that meet the requirements of Natural Resources Article §4-11A-09(g) shall be forwarded to the Office of Administrative Hearings for adjudication. Written requests for public informational meetings and/or Petitions of Protest must be received by the Department of Natural Resources Aquaculture Division 580 Taylor Avenue C-2 Annapolis, MD 21401 by Friday, February 15, 2013.
